Quotations are valid for 1 day(s) from date of issue and is based on information supplied by the consumer. Kgotso Build cannot be held responsible if a correct estimate is given on faulty instructions by the consumer.
Quotations are based on the price of goods as on the day that the quotation is requested and as such, subject to change taking into account external factors beyond the direct control of Kgotso Build such as import taxes, market fluctuations etc.
Quotations are regarded as accepted only by the reading of such Quotation, including these Terms and Conditions and followed by signature at the end indicating that the said Terms and Conditions have been read and understood and the Quotation is acceptable, failing which payment made of the deposit will be regarded as acceptance of the quotation and aforesaid terms and conditions.
Quotations are only considered accepted once signed and a 100% deposit is paid or order number is supplied. The balance is payable on collection of goods, unless negotiated in writing or credit terms in place.
The deposit amount on special order goods (goods that a supplier expressly or implicitly is required or expected to procure, create or alter specifically to satisfy the consumerís requirements) are 100%.
No materials will be invoiced or delivered before the Bank Deposit reflects in Kgotso Build‘s bank account.
Bank payments between any other bank and Standard Bank only reflects on the next working day if paid before 12:00.
Cheque deposits will only be cleared after 10 working days.
Clients should ensure that the correct colour paint is bought. Kgotso Build will not be held responsible for incorrect colour choices and it is advised that a sample colour be brought to the store.
The customer must allow five hours for mixing/matching of the paint from time of placing the order.
The customer MUST check paint colours upon receipt/delivery in order to secure satisfaction with the product and all instructions issued by the manufacturer must be adhered to. The paint/product must be used in accordance with the instructions provided on the container or uttered verbally.
If the paint is transported by the customer, the customer must ensure that the paint or other products are packed in an upright position and in a stable position. Kgotso Build does not accept any liability for damages/losses incurred if the product is transported by the customer.
Customers must ensure purchasing enough paint for the surface intended to paint due to the fact that there might be marginal differences in colours if mixed separately.
The colour(s) of paint is affected by external factors (sunlight, rain, dust, etc) and this may result in colour changes over time.
Refund Policy:
* We will not accept returns or allow exchanges if you do not provide proof of purchase and if the product is not in its original packaging.
* When purchasing goods, please consider your product selection. We do not allow returns and grant refunds, or permit exchanges should you simply change your mind or make the incorrect choice on our products and/or colours. Customers may opt between a return or refund, or exchange subject to proof of purchase in the following circumstances:
– Faulty products that do not perform as intended,
– Incorrectly described products or products which are different from the sample shown to you.
* Clients should ensure that the correct part / item specifications are supplied to Kgotso Build. We cannot be held responsible for incorrect product choices. A handling fee of 20% will be charged on all returned products when Kgotso Build supplied the correct item / part but the client gave the wrong description or specifications.
* All returns of products which are no longer in stock or batch, will carry a 50% handling fee to cover costs.
* Clients will have 10 (ten) business days to return goods.
With regards to all poison and chemicals, please request assistance form management before purchasing same to ensure that the correct product is bought. All warnings and safety instructions as referred to on the labelling or uttered verbally must be properly adhered to by the consumer. Kgotso Build cannot be held responsible for any damage, death or loss as a result of the consumers non compliance with the instructions.
Failure of the consumer to comply with these warnings, safety and usage instructions will vitiate the clients warranty and or guarantee.
All expiry / use by dates must be adhered to by consumers. All complaints after the relevant use by / expiry dates will be null and void.
Delivery times will be communicated to the client. Cost of which is not included in the quotation. Consumers will be required to accept an amended quotation if the client requests Kgotso Build to deliver material to any premises.
Consumers must abide by the advise/instructions given by Kgotso Build with regards to protective clothing and eyewear to be worn.
Special Order Goods may not be cancelled by consumers once the supplier has honoured the order or cut the material/part to ordered size. Clients will be held responsible for the full payment of all special order goods. As such, consumers have the responsibility of supplying the correct size and specifications before Kgotso Build is instructed to cut any part or glass to a specific size, as these materials will not be accepted as returns or be refunded.
In the event of a customer purchasing material for the purpose of re-selling or installation of same, Kgotso Build will not be held responsible for any failure, defects or claims as a result of negligence, misuse or abuse
Should the customer provide the measurements him/herself, Kgotso Build cannot be held responsible for incorrect sizing of the material. In order to secure correct measurements, it is advised that Kgotso Build takes the measurements
It is advised that qualified and knowledgeable persons use/install products supplied by Kgotso Build. Kgotso Build will not be held responsible if products are installed by an unqualified person to do so and warrantee and/or guarantee will become null & void.
I will not claim a refund or remedy and I accept full responsibility should the goods be damaged due to misuse, abuse, or gross negligence on my part. I also accept that these foregoing factors will vitiate my warrantee and/or guarantee
I do however accept that should the goods have a defect, failure or hazard, I will immediately inform the supplier and promptly claim my refund/remedy/repairs. Pertaining to the fact that the supplier has provided warnings and safety instructions in advance, I accept that when handling the goods I must comply with these instructions.
All goods and spares shall remain under the ownership of the supplier until the full invoice price has been paid.
The Warranty Period to repair/replace any defective or damaged goods is 3 to 6 Months. This does not apply to ordinary wear and tear.
Kgotso Build reserves the right to institute the necessary legal proceedings in the event of non-payment, which will entitle Kgotso Build to repossess goods supplied/ installed.
All costs incurred (legal and any other including client/attorney costs) by Kgotso Build in order to repossess goods, trace the customer and/or good and collection commission will be for the account of the consumer
The customer agrees that interest as stipulated by the Interest Act may be charged on all monies (outstanding & arrears) due in terms of this agreement.
In the event of the consumer being a private company or closed corporation, the authorised person hereby binds him/herself to be collectively and separately liable for payment of the outstanding amount due to Kgotso Build.
